LIETUVIŲ KALBA (ENGLISH BELOW)

 

Atsisiųsdamas (-a) ir naudodamas (-a) šiame projekte pateikiamus garso įrašus, natas ir kitą susijusią medžiagą (toliau – Turinys), patvirtinu, kad susipažinau (-au) su šiomis naudojimo sąlygomis ir su jomis sutinku.

 

1. Leidžiamas naudojimas

Turinys gali būti naudojamas nemokamai ir neribotai tik nekomerciniais tikslais, įskaitant:

  • mokymąsi, praktiką ir repeticijas;

  • edukacines veiklas;

  • asmeninę kūrybą (pvz., improvizaciją, aranžavimą, eksperimentavimą), išskyrus kūrinių išleidimą (išleidimui taikomos papildomos sąlygos, nurodytos 5 punkte);

  • nekomercinį turinio publikavimą (pvz., socialiniuose tinkluose), jei toks turinys nėra monetizuojamas.

 

2. Draudžiamas naudojimas

Be atskiro raštiško leidimo griežtai draudžiama:

  • naudoti Turinį komerciniais tikslais, įskaitant, bet neapsiribojant, reklama, pardavimais, mokamais pasirodymais, monetizuotu turiniu ar sinchronizacija su komerciniu audiovizualiniu turiniu;

  • naudoti Turinį politinėje reklamoje, politinėse kampanijose ar su jomis susijusioje komunikacijoje;

  • naudoti Turinį bet kokiame kontekste, kuris gali būti laikomas klaidinančiu, žeminančiu, diskriminuojančiu arba pažeidžiančiu galiojančius teisės aktus;

  • perparduoti, platinti ar kitaip perduoti Turinį tretiesiems asmenims kaip savarankišką produktą.

 

3. Autorystė ir teisės

Visos Turinio autorių teisės priklauso kūrėjams ir projekto partneriams. Naudojant Turinį būtina nurodyti šaltinį: „Backing Tracks: Vilnius JJAZZ Ensemble“

 

4. Atsakomybė

Naudotojas prisiima visą atsakomybę už Turinio naudojimą. Projekto organizatoriai neatsako už netinkamą ar šioms sąlygoms prieštaraujantį Turinio naudojimą.

 

5. Papildomos sąlygos išleidimui

Išleidžiant naujus įrašus, kuriuose naudojamas Turinys, jie turi būti registruojami kolektyvinio teisių administravimo organizacijose (AGATA ir LATGA), nurodant Turinio kūrėjus:

Atlikėjų informacija (AGATA):
Vilnius JJAZZ Ensemble turi būti nurodomas kaip vienas iš atlikėjų (pritariantysis instrumentalistas) ir gauna atitinkamą AGATA atlikėjų atlyginimo dalį.

Autorių informacija (LATGA):
Vilnius JJAZZ Ensemble turi būti nurodomas kaip vienas iš muzikos autorių ir gauna atitinkamą LATGA autorių atlyginimo dalį.

 

6. Leidimai komerciniam naudojimui

Dėl komercinio naudojimo ar kitų šiomis sąlygomis neapibrėžtų atvejų būtina iš anksto kreiptis ir gauti raštišką projekto organizatorių leidimą.

By downloading and using the audio recordings, sheet music, and other related materials provided as part of this project (hereinafter referred to as the Content), I confirm that I have read, understood, and agree to these Terms of Use.

1. Permitted Use

The Content may be used free of charge and without limitation for non-commercial purposes only, including:

  • learning, practicing, and rehearsing;

  • educational activities;

  • personal creative work (e.g. improvisation, arranging, experimentation), excluding commercial release (commercial releases are subject to the additional conditions set out in Section 5);

  • non-commercial publication of works using the Content (e.g. on social media), provided such publication is not monetized.

2. Prohibited Use

Without prior written permission, it is strictly prohibited to:

  • use the Content for any commercial purpose, including but not limited to advertising, sales, paid performances, monetized content, or synchronization with commercial audiovisual productions;

  • use the Content in political advertising, political campaigns, or related communications;

  • use the Content in any context that may be considered misleading, defamatory, discriminatory, unlawful, or otherwise in violation of applicable laws;

  • resell, redistribute, or otherwise make the Content available to third parties as a standalone product.

3. Copyright and Attribution

All intellectual property rights in the Content remain the property of the creators and project partners.

Whenever the Content is used, the following credit must be included:

"Backing Tracks: Songs of the Future / Vilnius JJAZZ Ensemble"

4. Liability

The user assumes full responsibility for their use of the Content. The project organizers shall not be liable for any misuse of the Content or any use that violates these Terms.

5. Additional Conditions for Commercial Releases

If new recordings incorporating the Content are commercially released, they must be registered with the relevant collective management organizations (AGATA and LATGA) and must credit the original creators of the Content as follows:

Performers (AGATA):
Vilnius JJAZZ Ensemble must be listed as one of the performers (supporting instrumental performer) and shall receive the corresponding share of AGATA performers' royalties.

Authors (LATGA):
Vilnius JJAZZ Ensemble must be listed as one of the music authors and shall receive the corresponding share of LATGA authors' royalties.

6. Commercial Licensing

For any commercial use, or for any use not expressly covered by these Terms, users must obtain prior written permission from the project organizers.
